Мэр Москвы внес очередные изменения в порядок работы российских организаций и правил посещения москвичами общественных мест (Указ Мэра Москвы от 25 июня 2021 г. № 38-УМ «О внесении изменений в указ Мэра Москвы от 8 июня 2020 г. № 68-УМ»).

Так, в частности продлевается приостановление оказания гражданам услуг общественного питания в фудкортах. Кроме того, в период с 23.00 до 6.00 не будут оказываться услуги общепита, проводиться зрелищноразвлекательные мероприятия в ночных клубах, барах, на дискотеках, в караоке.

Кроме того, с 28 июня 2021 г. возобновляется обязанность московских работодателей по переводу не менее 30% работников (в том числе и исполнителей по гражданско-правовым договорам) на дистанционный режим работы. При этом указывается, что количество таких работников, подлежащих переводу на дистанционный режим работы, определяется исходя из общего количества работников, исполнителей по гражданско-правовым договорам, уменьшенного на вакцинированных лиц. Факт вакцинации должен быть подтвержден сведениями в ЕМИАС или в ЕГИСЗ.

Также на дистанционном режиме работы остаются все работники старше 65 лет, и те, кто имеет заболевания, перечень которых определен Департаментом здравоохранения города Москвы.

Вышеуказанные ограничения по-прежнему не распространяются на тех, чье нахождение на рабочем месте является критически важным для обеспечения функционирования организаций, предпринимателей, а также тех, кто получил второй компонент вакцины или однокомпонентную вакцину от новой коронавирусной инфекции. Также ограничения не касаются организаций ОПК, авиастроения, организаций, входящие в состав госкорпорации космической деятельности «Роскосмос», организаций, входящие в состав госкорпорации по атомной энергии «Росатом», организаций, осуществляющих работу по гособоронзаказу, а также организаций электронно-технической отрасли, организаций здравоохранения и иных.

Работодатели должны определить численность работников, подлежащих и не подлежащих переводу на дистанционный режим работы. При этом должно быть обеспечено одновременное нахождение на рабочих местах не более 70% работников, исполнителей по гражданско-правовым договорам. Также должны быть приняты меры по минимизации очного присутствия работников, исполнителей по гражданско-правовым договорам на рабочих местах.

За нарушения вышеуказанных требований работодатели, могут быть привлечены к административной ответственности.
