С таким предложением бизнес-омбудсмен выступил на онлайн-совещании с региональными уполномоченными по защите прав предпринимателей. Он отметил1, что принимаемые государством антикризисные меры поддержки малых и микропредприятий касаются только тех, кто включен в Единый реестр МСП, администрируемый ФНС России. Реестр обновляется ежегодно 10 августа: в него вносятся новые участники, исключаются те, кто не представил сведения о среднесписочной численности работников или налоговую отчетность. При этом возвращение статуса МСП осуществляется по заявлению налогоплательщика не ранее 10 августа следующего года.
По мнению Бориса Титова, в условиях острого кризиса необходимо срочно внести изменения в Единый реестр МСП, не дожидаясь обычного срока, и до 1 мая включить в Реестр МСП предпринимателей, соответствующих установленным критериям (в том числе, отсутствующих в реестре по формальным причинам). Кроме того, следует проинформировать таких субъектов МСП о включении в Реестр и о полагающихся им мерах господдержки.
Также бизнес-омбудсмен заявил2, что подход в вопросе отнесения малых и средних предприятий к отраслям, наиболее пострадавшим от последствий коронавируса, формален и обесценивает масштабы потенциальной государственной поддержки. «Множество проблем возникает из-за того, что ОКВЭДы в этом перечне определены весьма формально. В результате у многих предпринимателей основной ОКВЭД в списке не значится, хотя сфера деятельности та же, или почти та же. И в помощи им отказывают», – отметил он.

В этой связи Уполномоченный предлагает признать пострадавшими все предприятия, независимо от отрасли, у которых выручка за первый квартал упала не менее чем на 30% по сравнению с тем же периодом прошлого года, если они сохранили численность своих коллективов не менее чем на 90%.
