Президент РФ Владимир Путин подписал федеральный закон, ограничивающий прокуроров и следователей в возобновлении уголовных дел. В частности, они смогут отменить постановление о прекращении уголовного дела только в течение года, причем по его окончании указанная отмена будет возможна только судебным решением. В этих целях Уголовно-процессуальный кодекс дополнен новой ст. 214.1 (Федеральный закон от 12 ноября 2018 г. № 411-ФЗ «О внесении изменений в Уголовно-процессуальный кодекс Российской Федерации»).
Отметим, что нововведение обусловлено принятием Постановления Конституционного Суда Российской Федерации от 14 ноября 2017 г. № 28-П. Напомним, что тогда Суд пришел к выводу, что неограниченное право прокурора возобновлять уголовные дела, прекращенные по реабилитирующим основаниям, не соответствует Конституции РФ. Закон вступит в силу 23 ноября.
