Законодательное Собрание Санкт-Петербурга предлагает скорректировать требования к изъятию из оборота некачественных и опасных пищевых продуктов, а также материалов и изделий1. В частности, предлагается внести уточнение, согласно которому изъятию из оборота будут подлежать некачественные и опасные пищевые продукты, материалы и изделия, а также указанные товары, реализуемые с нарушением следующих требований:
соблюдение требований нормативных документов; продажа в расфасованном и неупакованном виде, за исключением определенных видов; реализация только после проведения ветеринарно-санитарной экспертизы и получения продавцами заключений о соответствии таких продуктов требованиям ветеринарных правил и норм (ч. 1-3 ст. 20 Федерального закона от 2 января 2000 г. № 29-ФЗ «О качестве и безопасности пищевых продуктов», далее – закон о качестве и безопасности пищевых продуктов).
Причем владельцев продуктов, материалов и изделий, реализуемых с нарушением указанных требований, предлагается обязать незамедлительно изымать их из оборота. Положение о том, что в случае, если владелец некачественных и опасных пищевых продуктов, материалов и изделий не примет меры по их изъятию из оборота, они будут подлежать конфискации, менять не планируется (ч. 2 ст. 24 закона о качестве и безопасности пищевых продуктов). Вместе с тем не исключено, что если владелец пищевых продуктов, материалов и изделий, реализуемых с нарушением установленных требований, не осуществит их изъятие из оборота, то такую продукцию будут направлять на временное хранение до устранения выявленных нарушений. Речь идет о продуктах и материалах, не являющихся некачественными или опасными. Ожидается, что они будут подлежать строгому учету, а ответственность за их сохранность понесет владелец.
В случае принятия закон вступит в силу по истечении 10 дней после дня его официального опубликования.
