Соответствующий проект постановления Правительства РФ Минстрой России представил на общественное обсуждение. Предлагается1 17 видов наименований подготовительных работ геодезической, инженерной направленности проводить до выдачи разрешения на строительство объектов федерального, регионального и местного значения. Такие работы должны выполняться с соблюдением требований действующего законодательства, в том числе в области охраны окружающей среды, сохранения, использования, популяризации и государственной охраны объектов культурного наследия, требований технических регламентов.
Проект постановления разработан во исполнение ч. 1.1 ст. 52 Градостроительного кодекса, введенной в действие Федеральным законом от 31 июля 2020 г. № 254-ФЗ «Об особенностях регулирования отдельных отношений в целях модернизации и расширения магистральной инфраструктуры и о внесении изменений в отдельные законодательные акты Российской Федерации», который вступил в силу 31 июля.

Напомним, названный закон, в частности, регулирует отношения, возникающие при подготовке и утверждении документации по планировке территории. Предусматривается, что документация по планировке территории может быть разработана и утверждена при отсутствии приоритетного проекта. Так, работы, не причиняющие существенного вреда окружающей среде и ее компонентам, могут выполняться со дня направления проектной документации указанных объектов на экспертизу такой проектной документации.
Кроме того, в целях модернизации и расширения магистральной инфраструктуры законом определены особенности отнесения земель или земельных участков в составе таких земель к определенной категории земель, установления публичных сервитутов, изъятия земельных участков, особенности реконструкции, капитального ремонта существующих линейного объекта или линейных объектов в целях модернизации и расширения магистральной инфраструктуры и т. д.
Корреспондирующие поправки внесены также в Федеральные законы от 14 марта 1995 г. № 33-ФЗ «Об особо охраняемых природных территориях», от 23 ноября 1995 г. № 174-ФЗ «Об экологической экспертизе» и другие законодательные акты.
Антикоррупционная экспертиза и общественное обсуждение проекта постановления Правительства РФ, размещенного на федеральном портале проектов нормативных правовых актов, завершатся 24 августа.
