ФНС очистит ЕГРЮЛ от лжеадвокатов

ФНС применяет новый внесудебный порядок исключения из ЕГРЮЛ к нарушителям закона об адвокатуре.
По итогам проведенного мониторинга Адвокатская палата Новосибирской области и региональное управление ФНС выяснили, что в ЕГРЮЛ остались ООО, которые предоставили о себе недостоверные сведения: это «Юридическая консультация» («двойник» впервые ликвидированной организации), «Адвокат», «Адвокат-плюс» и «Санитарный адвокат». По данным налоговиков, руководство всех четырех фирм скрывало настоящие адреса их нахождения. УФНС внесло в реестр записи о недостоверности сведений, а после было принято решение о ликвидации этих четырех компаний, которые незаконно использовали в своих названиях термины, связанные с адвокатурой.При этом, по согласованию с АП НСО, УФНС решило применить новый внесудебный порядок исключения из ЕГРЮЛ.С 1 сентября 2017 года ст. 21.1 ФЗ «О государственной регистрации юридических лиц и индивидуальных предпринимателей» дополняется положением, которое предусматривает возможность исключения организации из ЕГРЮЛ по решению ФНС при наличии в реестре сведений, в отношении которых в течение шести месяцев хранится запись об их недостоверности. Глава АП НСО Андрей Жуков считает, что законодатель избавил налоговые органы и АП от судебных тяжб и дал возможность «наконец-то полностью очистить реестр от засилья лжеадвокатов».
