Сегодня на заседании Пленума Верховного Суда Российской Федерации было принято решение о направлении в Госдуму законопроекта «О внесении изменений в отдельные законодательные акты Российской Федерации в части назначения (избрания) мирового судьи на должность без ограничения срока полномочий». Текст документа имеется в распоряжении портала ГАРАНТ.РУ.
Согласно законопроекту полномочия мирового судьи не будут ограничиваться определенным сроком, сейчас такое правило установлено в отношении судей федерального суда (абз. 1 п. 1 ст. 11 Закона РФ от 26 июня 1992 г. № 3132-I «О статусе судей в Российской Федерации», далее – закон о статусе судей). Кроме того, в случае его принятия утратит силу п. 3 ст. 11 закона о статусе судей. Напомним, что в соответствии с указанной нормой мировой судья в первый раз назначается (избирается) на должность на срок, установленный законом соответствующего субъекта Федерации, но не более чем на пять лет. А его повторное избрание или назначение также определяется в соответствии с нормами регионального закона, но на срок также не более пяти лет. Вместе с тем ожидается, что предельный возраст пребывания в должности мирового судьи сохранится и как в настоящий момент будет составлять 70 лет (п. 2 ст. 7 Федерального закона от 17 декабря 1998 года № 188-ФЗ «О мировых судьях в Российской Федерации»).

В случае принятия закон вступит в силу по истечении 90 дней после дня его официального опубликования. Предполагается, что у органов государственной власти субъектов Федерации будет два месяца с момента официального опубликования закона, для того, чтобы привести свои правовые акты в соответствие с ним.
