Начиная с 26 июля управляющие организации, товарищества собственников жилья, жилищные или иные специализированные потребительские кооперативы, ресурсоснабжающие организации, региональные операторы по обращению с ТКО, которым вносится плата за жилое помещение и коммунальные услуги, не могут уступать право (требование) по возврату просроченной задолженности по таким платежам третьим лицам. Этот запрет распространяется в т. ч. и на кредитные организации и лиц, осуществляющих деятельность по возврату просроченной задолженности физлиц (коллекторов). Его нарушение влечет признание ничтожными заключенных договоров об уступке права (требования) по возврату долгов по ЖКХ (Федеральный закон от 26 июля 2019 г. № 214-ФЗ).
Исключением из указанного запрета признаются лишь случаи уступки права (требования) по возврату просроченной задолженности по внесению платы за жилое помещение и ЖКУ вновь выбранной, отобранной или определенной управляющей организации, созданным ТСЖ либо жилищному или иному специализированному потребительскому кооперативу, иной ресурсоснабжающей организации, отобранному региональному оператору по обращению с ТКО. При этом право взыскивать просроченную задолженность по ЖКХ в судебном порядке предоставлено только наймодателю жилого помещения, управляющей организации, иному юрлицу или ИП, которым вносится плата за жилое помещение и коммунальные услуги, а также их представителям.
Допускается ли раскрытие сведений о должнике, просроченной задолженности и ее взыскании неограниченному кругу лиц путем размещения таких сведений в Интернете, расклейки объявлений, сообщения по месту работы должника и т. п.? Отметим, в ходе рассмотрения закона в него была дополнительно включена норма, согласно которой каждый собственник помещения в многоквартирном доме самостоятельно исполняет обязанности по договору управления многоквартирным домом, включая внесение платы за жилое помещение и коммунальные услуги, и не отвечает по обязательствам других собственников помещений в этом доме. Это призвано сделать невозможным погашение долгов за счет соседей.
Соответствующие поправки вступили в силу со дня официального опубликования федерального закона (с 26 июля).
