Группа депутатов Госдумы во главе с Эрнестом Валеевым предложила увольнять прокурорских работников в связи с выходом в отставку и по инициативе руководителя органа или организации прокуратуры в случаях:
отказа от назначения на должности, предложенные в связи с истечением срока полномочий или их досрочным прекращением; отсутствия на службе в течение более четырех месяцев подряд в связи с временной нетрудоспособностью (если законодательством не установлен более длительный срок сохранения места работы (должности) при определенном заболевании или при отсутствии гарантий по сохранению места работы (должности)1.
При этом в последнем случае за указанными работниками предполагается сохранять место работы (должность) в период его временной нетрудоспособности в связи с увечьем, профессиональным заболеванием или другим повреждением здоровья, связанным с исполнением служебных обязанностей, независимо от продолжительности этого периода.
Также планируется установить правило, согласно которому прокурорский работник может быть уволен в период больничного или отпуска в случае нарушения им присяги прокурора. Это будет возможно в случае, если такое нарушение нанесет ущерб авторитету прокуратуры РФ и дискредитирует его самого.
Предполагается, что по окончании срока полномочий по замещаемой должности, а также в случае их досрочного прекращения по основаниям, не требующим безусловного увольнения из органов прокуратуры, для решения вопроса об условиях дальнейшего прохождения службы прокуроры могут быть зачислены в распоряжение Генеральной прокуратуры РФ, прокуратуры субъекта Федерации и приравненной к ней специализированной прокуратуры.

В распоряжении этих госорганов указанные прокуроры будут находиться до двух месяцев со дня издания соответствующего акта Президента РФ, Генерального прокурора РФ. Ожидается, что порядок зачисления и нахождения прокурорского работника в распоряжении органа прокуратуры, объем исполнения им служебных обязанностей в указанный период будет определять Генеральный прокурор РФ. В этот период прокурорскому работнику будут предлагать как вакантные должности, соответствующие его квалификации, так и вакантные нижестоящие должности, имеющиеся в данном органе прокуратуры, а в случае их отсутствия – соответствующие вакантные должности в других органах прокуратуры, в том числе расположенных в других местностях с учетом его состояния здоровья.
Во время нахождения прокурора в распоряжении органа прокуратуры за ним предполагается сохранять его статус, гарантии правовой и социальной защиты, а также денежное содержание в размере должностного оклада по последней замещаемой должности, доплат за классный чин, за выслугу лет с учетом коэффициентов, процентных надбавок за работу в местностях с неблагоприятными климатическими или экологическими условиями, в том числе отдаленных. Если прокурор будет выполнять в указанный период какие-либо служебные обязанности, то ему планируется выплачивать соответствующее денежное содержание.
Время нахождения прокурорского работника в распоряжении органа прокуратуры предполагается засчитывать в календарном исчислении в общий трудовой стаж, в стаж службы, дающий право на присвоение очередного классного чина и предоставление дополнительного отпуска, в выслугу лет для установления доплаты и назначения пенсии. Но в случае отказа от замещения предлагаемых вакантных должностей прокурорского работника планируется увольнять из органов прокуратуры.
