Президент РФ Владимир Путин подписал Федеральный закон от 18 февраля 2020 г. № 25-ФЗ «О внесении изменений в статьи 150 и 151 Уголовно-процессуального кодекса Российской Федерации»1, которым к подследственности следователей органов внутренних дел теперь отнесены уголовные дела о преступлениях, предусмотренных ч. 3 ст. 242 Уголовного кодекса, а именно, дела о незаконном изготовлении и (или перемещении) через границу РФ в целях распространения порнографической продукции, о ее демонстрации и рекламе, в том числе среди несовершеннолетних и с вовлечением несовершеннолетнего в оборот такой продукции лицом, достигшим восемнадцатилетнего возраста, совершенных:
группой лиц по предварительному сговору или организованной группой;с использованием СМИ, включая Интернет;с извлечением дохода в крупном размере.
Напомним, ранее по преступлениям, предусмотренным ст. 242 УК РФ, производилось дознание (когда предварительное расследование необязательно). Однако, как следует из пояснительной записки к закону, в последнее время отмечено увеличение количества зарегистрированных преступлений, предусмотренных ч. 3 ст. 242 УК РФ, то есть отягощенных квалифицирующими признаками, и одновременное снижение их раскрываемости. Необходимость внесения изменений обусловлена также ограниченным сроком производства дознания, в то время как по делам указанной категории требуется назначение ряда судебных экспертиз.
Закон вступит в силу 29 февраля.
