Владимир Путин подписал поправки в Федеральный закон от 18 июля 2011 г. № 223-ФЗ «О закупках товаров, работ, услуг отдельными видами юридических лиц» (далее – Закон № 223-ФЗ), которые позволят распространить его положения на закупки, осуществляемые региональными операторами по обращению с твердыми коммунальными отходами, в рамках данного закона (Федеральный закон от 22 декабря 2020 г. № 443-ФЗ). Внесенные поправки обусловлены тем, что деятельность юрлиц в статусе региональных операторов регулируется положениями Федерального закона от 24 июня 1998 г. № 89-ФЗ «Об отходах производства и потребления», иными нормативными правовыми актами в области обращения с отходами и является шире, чем указано в Законе № 223-ФЗ о деятельности в сфере обработки, утилизации, обезвреживания и захоронения твердых коммунальных отходов. Новая редакция закона распространяет его положения на закупки региональных операторов с указанием на их деятельность как на деятельность по обращению с твердыми отходами.

Отдельно прописываются сроки приведения в соответствие с названными изменениями положений о закупках и внесения в единую информационную систему (не позднее чем в течение 90 дней со дня вступления в силу изменений). При этом закупки, извещения об осуществлении которых были размещены в единой информационной системе до даты положения о закупке, приведенного в соответствии с требованиями Закона № 223-ФЗ с учетом принятых изменений, но не позднее чем в течение 90 дней со дня вступления в силу поправок, должны быть завершены по правилам, действовашим на дату размещения такого извещения. Подписанный Президентом РФ закон вступит в силу 2 января.
