Президент РФ подписал закон, вносящий поправки в порядок предоставления ипотечных каникул гражданам (Федеральный закон от 2 июля 2021 г. № 327-ФЗ). Изменения вступили в силу со дня официального опубликования закона.
Напомним, что ипотечные каникулы (требование о приостановлении исполнения заемщиком своих обязательств либо уменьшение размера платежей на определенный срок) предоставляются банком при соблюдении ряда условий. Одно из них является нахождение заемщика в трудных жизненных условиях (подп. 4 п. 1 ст. 6.1-1 Федерального закона от 21 декабря 2013 г. № 353-ФЗ).
Согласно внесенным поправкам, под таки обстоятельствами понимается не только регистрация заемщика в качестве безработного гражданина, но и прекращение трудового договора или служебного контракта у гражданина, которому назначена страховая пенсия по старости.

Кроме того, скорректирован и перечень документов, подтверждающих нахождение заемщика в трудной жизненной ситуации. К ним теперь жет относиться трудовая книжка гражданина, которому назначена страховая пенсия по старости, содержащая запись о прекращении трудового договора или служебного контракта. Для предпринимателей, применяющих спецрежим подтверждением может быть справка о состоянии расчетов (доходах) по налогу на профессиональный доход (НПД). Если заемщик является ИП и применяет УСН, ПСН или ЕСХН, то он может представить книгу учета доходов и расходов и хозяйственных операций.
