19 ноября 2020 года в УФНС России по г. Москве прошел онлайн-вебинар для налогоплательщиков на тему исполнения налоговых уведомлений за налоговый период 2019 года. ФНС России на своем официальном сайте опубликовала ответы на поступившие вопросы граждан.
Так, например, указывается, что в случае неполучения налогового уведомления в личном кабинете налогоплательщика и при наличии налогооблагаемого имущества, налогоплательщику необходимо обратиться в налоговую инспекцию либо направить соответствующую информацию или через ЛК или с использованием интернет-сервиса ФНС России «Обратиться в ФНС России».
При этом стоит учесть, что налоговые уведомления не направляются в случае наличия налоговой льготы, налогового вычета, иных установленных законодательством оснований, полностью освобождающих владельца объекта налогообложения от уплаты налога. Или же если общая сумма налогов, отражаемых в налоговом уведомлении, составляет менее 100 руб.. В последнем случае исключение делается только при направлении налогового уведомления в календарном году, по истечении которого утрачивается возможность его направления налоговым органом.

Если налогоплательщик имеет право на налоговую льготу, не представил в налоговый орган заявление о ее предоставлении или не сообщил об отказе от применения налоговой льготы, то она будет предоставляться на основании сведений, полученных налоговым органом в рамках межведомственных отношений. Так, например, ПФР передает в налоговую службу сведения о принятых решениях о назначении пенсии, прекращении выплаты пенсии, о лицах, соответствующих условиям, необходимым для назначения пенсии, а также о лицах, сведения о которых внесены в федеральный реестр инвалидов. В случае, если такие сведения не получены налоговым органом, то гражданин, для предоставления льготы самостоятельно представляет заявление (приказ ФНС России от 14 ноября 2017 г. № ММВ-7-21/897@). При этом, срок подачи заявления о предоставлении льготы действующим налоговым законодательством не определен. Подать заявление о предоставлении налоговой льготы в налоговый орган можно любым удобным способом: через личный кабинет налогоплательщика, почтовым сообщением, путем личного обращения в любую налоговую инспекцию или через уполномоченный МФЦ.
