Правительство РФ предлагает установить правило, согласно которому по окончании срока договора аренды государственного или муниципального имущества, заключенного по результатам проведения торгов или без их проведения, его пролонгация, по общему правилу осуществляется без проведения конкурса или аукциона. Однако для этого, как и в настоящий момент, потребуется выполнение двух условий:
размер арендной платы определяется по результатам оценки рыночной стоимости объекта, проводимой в соответствии с законодательством об оценочной деятельности; минимальный срок пролонгации составляет не менее трех лет (хотя за арендатором сохраняется право подать заявление о его уменьшении) (ч. 9 ст. 17.1 Федерального закона от 26 июля 2006 года № 135-ФЗ «О защите конкуренции», далее – закон о конкуренции).
При этом уточняется, что нововведения будут также распространяться на пролонгацию договоров аренды государственного или муниципального имущества, заключенных до 2 июля 2008 года1.

Сейчас правила пролонгации договоров аренды государственного и муниципального имущества действуют только в отношении имущества, определенного ч. 1 и ч. 3 ст. 17.1 закона о конкуренции. А это, как поясняет кабмин, дает арендодателям возможность отказываться от пролонгации договоров аренды госимущества, заключенных до вступления в силу ст. 17.1 закона о конкуренции. Таким образом, в случае принятия предлагаемого кабмином законопроекта продление таких соглашений не будет зависеть от даты их заключения, а также процедур, по результатам которых это произошло.
