Михаил Мишустин подписал распоряжение от 4 апреля 2020 г. № 898-р1, опубликованное вчера на официальном интернет-портале правовой информации, которое предусматривает возврат туроператорами туристам денежных средств, уплаченных за турпутевку, если поездка планировалась в период с начала действия ограничений в иностранном государстве, в частности, в связи с распространением коронавируса до 1 июня 2020 г. Расходы по выплате возвратных денежных средств туристам должны осуществляться из средств фонда персональной ответственности туроператора в том случае, если не позднее 15 апреля 2020 года туроператор представит в объединение туроператоров в сфере выездного туризма уведомление о таком возврате. Туроператор, не представивший указанное уведомление, будет обязан перечислить ежегодный взнос за 2020 год в фонд персональной ответственности туроператора не позднее 15 апреля 2021 г.
Особенности формирования фонда персональной ответственности туроператора в сфере выездного туризма предусмотрены в ст. 11.6 Федерального закона от 24 ноября 1996 г. № 132-ФЗ «Об основах туристской деятельности в Российской Федерации» (далее – Закон № 132-ФЗ). Согласно ст. 11.8 Закона № 132-ФЗ туристу и (или) иному заказчику должна быть возвращена денежная сумма, равная общей цене туристского продукта, а после начала путешествия – часть указанной общей цены в размере, пропорциональном стоимости не оказанных туристу услуг.

Напомним, ранее Правительство РФ фактически освободило туроператоров от уплаты взносов за 2020 год в резервный фонд объединения туроператоров в сфере выездного туризма (распоряжение Правительства РФ от 18 марта 2020 г. № 660-р).
Кроме того, из резервного фонда Правительства РФ Ростуризму выделены бюджетные ассигнования в размере до 3,5 млрд руб. для предоставления туроператорам в 2020 году субсидий на возмещение затрат по договорам реализации турпутевок и по обеспечению вывоза туристов из государств, в которых сложилась неблагоприятная ситуация в связи с коронавирусом (распоряжение Правительства РФ от 7 апреля 2020 г. № 909-р2).
