Минюст России направил руководителям субъектов РФ предложение обеспечить адвокатам и нотариусам при исполнении ими обязанностей по оказанию юридической помощи возможность свободного передвижения на территории соответствующего региона по предъявлении ими удостоверений. Данная инициатива обусловлена необходимостью соблюдения конституционных гарантий граждан на получение квалифицированной юридической помощи.
Как сообщает1 министерство, ФПА РФ и ФНП РФ выражают обеспокоенность по данному вопросу и предпринимают значительные меры по обеспечению максимальной доступности услуг нотариусов и адвокатов населению. Так, например, по рекомендациям ФНП РФ в регионах организована работа нотариусов в режиме «дежурных нотариальных контор».
Ранее портал ГАРАНТ.РУ также писал об обращении адвокатского сообщества к Мэру г. Москвы и Губернатору Московской области с подобным запросом. В частности, ФПА РФ предложила внести изменения в нормативные правовые акты, которые позволили бы не распространять на адвокатов действующие ограничения, выраженные в обязанности соблюдения режима самоизоляции. Также озвучивалось предложение о необходимости свободного передвижения адвокатов для осуществления своих профессиональных обязанностей на территории г. Москвы и МО и рассмотрении вопроса о выдаче специальных пропусков для этих целей членам и работникам адвокатских образований.

Напомним, в соответствии с Указом Президента РФ от 2 апреля 2020 г. № 239 главы регионов уполномочены в пределах срока с 4 по 30 апреля самостоятельно устанавливать исходя из объективной ситуации по распространению новой коронавирусной инфекции на территории конкретного субъекта РФ комплекс ограничительных мер, в том числе предусматривать отдельные ограничения по порядку передвижения на соответствующей территории граждан и транспортных средств.
