Пункт 4 правил пользования жилыми помещениями, утвержденных постановлением Правительства РФ от 21 января 2006 г. № 25, приведен в соответствие с положениями Жилищного кодекса, которыми с 1 октября запрещено оказание гостиничных услуг в жилых помещениях МКД (Федеральный закон от 15 апреля 2019 г. № 59-ФЗ).
Так, помимо существующего запрета размещения промышленных производств, в жилых помещениях не допускается размещение гостиниц. В постановлении1 приведена отдельная норма о том, что не может быть использовано для предоставления гостиничных услуг жилое помещение в МКД.
Также запрещено осуществление миссионерской деятельности в жилых помещениях, кроме случаев, предусмотренных ст. 16 Федерального закона от 26 сентября 1997 г. № 125-ФЗ «О свободе совести и о религиозных объединениях». Тем самым проведение богослужений, религиозных обрядов, собраний и церемоний в жилых помещениях разрешается.
Положение, допускающее в жилом помещении осуществление индивидуальной предпринимательской, иной профессиональной деятельности наряду с проживанием, если такая деятельность не нарушает права и законные интересы других граждан, а также требования по содержанию жилого помещения, не претерпело изменений.
Соответствующее постановление Правительства РФ опубликовано на официальном интернет-портале правовой информации 11 ноября и вступит в силу 19 ноября.
