Напомним, в 2020 году не проводятся проверки, предусмотренные Федеральным законом от 26 декабря 2008 г. № 294-ФЗ «О защите прав юридических лиц и индивидуальных предпринимателей при осуществлении государственного контроля (надзора) и муниципального контроля», за исключением проверок, указанных Постановлением Правительства РФ от 3 апреля 2020 г. № 438.
Теперь такая внеплановая проверка может быть назначена и по инициативе субъектов МСП для признания ранее наложенного органами контроля предписания исполненным. Также вне плана могут подвергнуться проверке НКО в случае поступившей информации о нарушении законодательства о деятельности НКО, избирательного законодательства, закона о гостайне или о наличии признаков экстремизма в деятельности. Соответствующее Постановление Правительства РФ от 13 июня 2020 г. № 862 вступило в силу 17 июня.

Кроме того, в отношении остальных юрлиц и ИП, которые не являются субъектами МСП, в 2020 году проводятся только те внеплановые проверки, которые указаны в п. 1 Постановления Правительства РФ от 3 апреля 2020 г. № 438 (с учетом вносимых настоящих дополнений), а также плановые проверки тех организаций и ИП, деятельность которых отнесена к категориям чрезвычайно высокого и высокого риска. При этом плановые проверки при осуществлении госконтроля качества и безопасности медицинской деятельности в 2020 году не проводятся.
Отмечается, что отдельные виды проверок разрешительной деятельности допустимы в соответствии с Постановлением Правительства РФ от 3 апреля 2020 г. № 440.
