Законодательное собрание Краснодарского края выступило с инициативой установить правило, согласно которому госзакупки будут планироваться исключительно посредством формирования, утверждения и ведения планов-графиков. В настоящий момент для этого также служат планы закупок (ч. 1 ст. 16, ст. 17 Федерального закона от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд», далее – Закон № 44-ФЗ).
Необходимость новшества1 объясняется тем, что указанные документы планирования формируются на разные сроки: план закупок – на срок, соответствующий сроку действия закона о бюджете на очередной финансовый год и плановый период, а план-график закупок – на один финансовый год. Такая ситуация, по мнению разработчиков документа, усложняет муниципальным заказчикам составление этих планов в условиях однолетнего бюджета. Кроме того, в пояснительной записке к законопроекту акцентируется внимание на том, что информация в документах дублируется, а госзаказчики помимо них заполняют другие обязательные формы в отношении каждого объекта закупки, определяют и обосновывают начальную (максимальную) цену контракта. При том, что вносимые в эти формы данные совпадают с информацией в плане и плане-графике закупок.

Документом предлагается внести и другие поправки в Закон № 44-ФЗ, в частности, уточнить процедуру госзакупок у учреждений и предприятий уголовно-исполнительной системы и организаций инвалидов, и тем самым снизить риск привлечения заказчиков к административной ответственности.
Напомним, что с 1 января следующего года изменятся правила авансирования по контрактам. В частности, размер последующих после выплаты аванса платежей будет зависеть от того, предусмотрены ли контрактом этапы, и последовательности их исполнения.
