На федеральном портале проектов нормативных правовых актов размещен проект постановления Правительства РФ, предусматривающий временный порядок заключения, изменения, прекращения и учета соглашений о защите и поощрении капиталовложений. Общественное обсуждение по проекту продлится до 16 июля. Разработчиком является Минфин России. Документ1 подготовлен во исполнение Федерального закона от 1 апреля 2020 года № 69-ФЗ «О защите и поощрении капиталовложений в Российской Федерации» (далее – Закон № 69-ФЗ), о принятии которого портал ГАРАНТ.РУ писал ранее.
В частности, предлагается установить порядок заключения инвестиционного соглашения в рамках частной проектной инициативы. Предъявляются требования к заявителю и инвестиционному проекту. Так, заявителем может быть российское юрлицо, которое одновременно отвечает следующим условиям:
юрлицо отвечает признакам организации, реализующей проект, установленным п. 8 ч. 1 ст. 2 Закона № 69-ФЗ; в отношении юрлица не возбуждено дело о банкротстве; в отношении юридического лица не проводятся процедуры ликвидации; заявитель не включен в реестр недобросовестных поставщиков (подрядчиков, исполнителей).

Соглашение может быть заключено в отношении инвестиционного проекта, для которого одновременно соблюдаются следующие условия:
инвестиционный проект отвечает признакам, предусмотренным п. 3 ч. 1 ст. 2 Закона № 69-ФЗ; он отвечает признакам нового инвестиционного проекта, предусмотренным п. 6 ч. 1 ст. 2 Закона № 69-ФЗ; сфера реализации инвестиционного проекта отвечает требованиям, установленным ст. 6 Закона № 69-ФЗ; планируемый заявителем размер капиталовложений в инвестиционный проект соответствует п. 2 или п. 3 ч. 4 ст. 9 Закона № 69-ФЗ; вложенные в инвестиционный проект денежные средства отвечают требованиям, установленным п. 5 ч. 1 ст. 2 Закона № 69-ФЗ.
Проектом временного порядка также предусматриваются особенности раскрытия информации о бенефициарных владельцах организации, реализующей инвестиционный проект, порядок и условия признания ранее заключенного договора в качестве связанного договора, порядок ведения реестра заключенных соглашений, внесения изменений и прекращения инвестиционого соглашения и т. д. Предполагается, что принятие документа позволит обеспечить заключение, внесение изменений, прекращение и учет соглашений о защите и поощрении капиталовложений на бумажных носителях до создания государственной информационной системы «Капиталовложения».
