Проект соответствующего постановления Правительства РФ подготовил Минпромторг России. Это связано с тем, что 28 февраля завершается эксперимент по маркировке табачной продукции средствами идентификации, стартовавший 15 января 2018 года (п. 1 постановления Правительства РФ от 27 ноября 2017 г. № 1433 «О проведении эксперимента по маркировке табачной продукции средствами идентификации и мониторингу оборота табачной продукции»), и с 1 марта этого года она станет обязательной.
В соответствии с документом1 для регистрации в информационной системе мониторинга участники оборота табачной продукции будут направлять в нее соответствующее заявление, подписанное усиленной квалифицированной электронной подписью руководителя организации или ИП со сведениями о:
типе участника оборота табачной продукции (производитель, организация оптовой или розничной торговли, импортер); ИНН участника оборота табачной продукции; Ф. И. О. лица, имеющего право действовать от имени участника оборота табачной продукции без доверенности; адресе электронной почты участника оборота табачной продукции, на который будет осуществляться направление уведомлений из информационной системы.
С примером заполнения уведомления о снятии с учета организации или ИП в качестве плательщика торгового сбора в налоговом органе по объекту осуществления вида предпринимательской деятельности, в отношении которого установлен торговый сбор , подготовленным экспертами компании «Гарант», можно ознакомиться в интернет-версии системы ГАРАНТ. Ожидается, что средство идентификации будет содержать код маркировки, включающий в себя четыре группы данных, а на потребительской упаковке будет представлено двумерным штрих-кодом в формате DataMatrix.
Уточняется, что действие правил не будет распространяться на отдельные виды табачной продукции, в частности, на продукцию: реализуемую в магазинах беспошлинной торговли; ввозимую в страну физлицами и приобретенная ими для личного пользования; хранящуюся под таможенным контролем в зонах таможенного контроля, в том числе на складах временного хранения и таможенных складах. Также ожидается, что исключение будет распространяться на табачную продукцию, ввозимую в страну организаторами и участниками международных выставок и ярмарок в качестве образцов и экспонатов, не предназначенную для реализации (продажи).
Публичное обсуждение и независимая антикоррупционная экспертиза документа завершатся 27 февраля. Напомним, что для ряда товаров маркировка средствами идентификации станет обязательной с 1 декабря текущего года, в числе которых духи, туалетная вода и предметы одежды.
