На вопрос о возможности изменения технического задания по госконтракту о поставке продуктов питания, а именно, замены поставки фруктового джема в банках объемом 600-700 г общим объемом 700 кг на тару с меньшим объемом 400 г, но без изменения общего объема поставки эксперты службы Правового консалтинга ГАРАНТ ответили, что стороны не вправе изменять существенные условия контракта по Федеральному закону от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» (далее – Закон № 44-ФЗ).
Так, согласно ст. 432 Гражданского кодекса договор считается заключенным, если между сторонами в требуемой в подлежащих случаях форме достигнуто соглашение по всем существенным условиям договора. Существенными являются условия о предмете договора, условия, которые названы в законе или иных правовых актах как существенные или необходимые для договоров данного вида, а также все те условия, относительно которых по заявлению одной из сторон должно быть достигнуто соглашение.
Описание объекта закупки может включать в себя спецификации, планы, чертежи, эскизы, фотографии, результаты работы, тестирования, требования, в том числе в отношении проведения испытаний, методов испытаний, упаковки в соответствии с требованиями ГК РФ, маркировки, этикеток, подтверждения соответствия, процессов и методов производства в соответствии с требованиями технических регламентов, документов, разрабатываемых и применяемых в национальной системе стандартизации, технических условий, а также в отношении условных обозначений и терминологии (п. 3 ч. 1 ст. 33 Закона № 44-ФЗ).

Исходя из этого, если при описании объекта закупки заказчик указал требования к упаковке, таре, фасовке поставляемого товара в документации о закупке или в проекте контракта, то такие требования являются существенными условиями исполнения контракта (письмо Минэкономразвития РФ от 20 апреля 2017 г. № ОГ-Д28-4609). При этом в исключительных случаях существенные условия госконтракта могут быть изменены. Такие исключения предусмотрены в ст. 34 и ст. 95 Закона № 44-ФЗ и распространяются на все контракты, способ осуществления закупки значения не имеет (письмо Минфина России от 21 июня 2017 г. № 24-05-08/38833).
Исчерпывающий перечень случаев, когда условия контракта можно изменить при его исполнении (то есть уже после его подписания), содержится в ч. 1 и ч. 7 ст. 95 Закона № 44-ФЗ. В любых других случаях изменение условий контракта неправомерно и влечет административную ответственность, предусмотренную ч. 4 и ч. 5 ст. 7.32 КоАП.
