Банк России проанализировал практику заключения страховыми компаниями договоров страхования на случай заражения новой коронавирусной инфекции в период пандемии. Как сообщается в письме от 19 июня 2020 г. № ИН-06-59/1021, которое направлено регулятором в адрес страховых организаций, в ходе мониторинга таких страховых полисов выявлено, что нередко правила страхования давали возможность отказать заболевшему новой коронавирусной инфекцией страхователю в выплате страхового возмещения либо увеличить срок выплаты страхового возмещения, либо позволяли исключить из страхового покрытия особо опасные инфекционные болезни, к которым относится инфекция COVID-19, при наступлении форс-мажорных обстоятельств, к которым как раз и относятся эпидемия или пандемия. При этом в договоре страхования не прописывалось, что в случае заражения COVID-19 условия форс-мажора отменяются.

В этой связи Банк России в целях предупреждения нарушения прав потребителей страховых услуг не допускает использование страховыми организациями в договорах страхования, правилах страхования и иных продуктах страхования рисков, связанных с заражением новой коронавирусной инфекцией, взаимоисключающих положений при наступлении страхового случая, в том числе для увеличения срока выплаты страхового возмещения.
