Президент РФ в своем обращении к гражданам от 25 марта 2020 г. предложил изменить порядок начисления пособий по листкам нетрудоспособности. В связи с этим в Госдуму был внесен соответствующий законопроект.
Документом1 предлагается предусмотреть ряд особенностей по выплате пособия по больничным листам за периоды нетрудоспособности с 1 апреля 2020 года по 31 декабря 2020 года (включительно). Так, если пособие в расчете за полный календарный месяц ниже установленного федеральным законом МРОТ, то для расчета выплачиваемого размера пособия берется размер МРОТ. Тогда размер дневного пособия определяется путем деления МРОТ на число календарных дней в календарном месяце, на который приходится период временной нетрудоспособности.
Размер пособия подлежащий выплате исчисляется путем умножения указанного размера дневного пособия на число календарных дней больничного в каждом календарном месяце.
При этом, если в районе установлены специальные коэффициенты к зарплате, то они будут применяться и к МРОТ, используемому для расчета пособия.
Законопроектом также устанавливается порядок оплаты больничных листов в случаях, когда застрахованное лицо на момент наступления страхового случая работает на условиях неполного рабочего времени (неполной рабочей недели, неполного рабочего дня). В этой ситуации размер пособия по временной нетрудоспособности, исчисленного исходя из МРОТ, определяется пропорционально продолжительности рабочего времени застрахованного лица.
Вышеуказанные правила начисления пособия по больничным листам будут действовать по 31 декабря 2020 года (включительно).
Также, законопроектом предлагается приостановить до 1 октября 2020 г. нормы, предусматривающие обязанность получателей ежемесячных выплат в связи с рождением (усыновлением) первого или второго ребенка подавать заявление о назначении указанных выплат на новый срок, а также извещать органы исполнительной власти субъектов РФ, осуществляющие полномочия в сфере социальной защиты населения, и территориальные органы ПФР о смене места жительства (пребывания), фактического проживания, а также обстоятельствах, влекущих прекращение осуществления указанной выплаты. В указанный период в целях сохранения здоровья граждан и недопущения распространения новой коронавирусной инфекции в России, посещение указанных органов гражданами будет прекращено, а их назначение будет осуществлять без подачи гражданами соответствующих заявлений.
