Правительство РФ подготовило законопроект, предусматривающий внесение изменений в Федеральный закон от 2 декабря 1990 г. № 395-I «О банках и банковской деятельности» (далее – Закон № 395-I).
В частности, предлагается дополнить ст. 29 Закона № 395-I, устанавливающую права и обязанности банков по определению размеров процентных ставок и комиссионного вознаграждения. Новая норма может избавить граждан от необходимости оплаты комиссии за денежный перевод между разными подразделениями в разных регионах одного и того же банка.
Как следует из пояснительной записки к тексту проекта закона, филиалы конкретного банка входят в его единую систему, и переводы клиентов – физических лиц между счетами, открытыми в территориальных подразделениях разных регионов, являются обычными внутренними банковскими переводами. Они не создают добавленной стоимости, и кредитная организация тем самым не оказывает гражданам какой-либо дополнительной услуги. Разработчики законопроекта отмечают, что установление комиссии за переводы в пределах Российской Федерации указывает на межрегиональную дискриминацию потребителей банковских услуг, которую необходимо устранить внесением соответствующих изменений в закон.
В числе позитивных перемен от принятия законопроекта1 авторы видят:
свободное перемещение денежных потоков за счет послаблений требований; развитие системы безналичных платежей; прекращение практики дискриминационного подхода при осуществлении банковских услуг; стимулирование кредитных организаций к совершенствованию бизнес-процесса в целях улучшения качества предоставляемых услуг.
Данные изменения направлены на обеспечение единства экономического пространства, подчеркивается в пояснительной записке.
Кроме того, в сентябре сего года на рассмотрение Госдумы внесен законопроект2 о внесении изменения в Закон № 395-I, предусматривающего запрет на взимание с держателей платежных карт комиссии по операциям, осуществляемым между кредитной организацией, выпустившей платежную карту, и иной кредитной организацией. В данный момент он находится на рассмотрении Комитета Госдумы по финансовому рынку.
