Группа депутатов Госдумы во главе с Алексеем Балыбердиным предлагает освободить юрлиц и ИП от обязанности по направлению сведений о лицензиях в Единый федеральный реестр сведений о фактах деятельности юрлиц (далее – ЕФРС). Необходимость такого нововведения аргументируется тем, что ФНС России и так фактически передает эти сведения в ЕФРС из ЕГРЮЛ и ЕГРИП. А сведения о лицензиях, полученных предпринимателем, представляются туда лицензирующими органами в форме электронных документов (п. 8 ст. 7.1, п. 4 ст. 5 Федерального закона от 8 августа 2001 г. № 129-ФЗ «О государственной регистрации юридических лиц и индивидуальных предпринимателей»).
Также разработчики документа1 обращают внимание на тот факт, что обязанность юрлиц и ИП предоставлять информацию, уже имеющуюся в распоряжении других органов власти, в ЕФРС нарушает принципы регулирования отношений, связанных с информационным взаимодействием предпринимателей и государства. Планируется, что вносить в ЕФРС информацию о получении лицензии, ее приостановлении, возобновлении, переоформлении, аннулировании, а также ее прекращении по другим основаниям будет ФНС России на основании данных в ЕГРЮЛ и ЕГРИП. В случае принятия закон вступит в силу по истечении трех месяцев после его официального опубликования.
Напомним, что в середине января Конституционный Суд Российской Федерации в своем решении указал, что при решении вопроса о наказании за осуществление предпринимательской деятельности с нарушением лицензионных требований должен соблюдаться трехмесячный срок давности привлечения к административной ответственности. Однако у потребителей есть право требовать возмещения убытков и компенсации морального вреда за нарушение своих прав в течение года.
