Депутаты Самарской Губернской Думы предлагают установить правило, в соответствии с которым срок оплаты заказчиком поставленного товара, выполненной работы (ее результатов) или оказанной услуги по договору (его отдельному этапу) должен составлять не более 30 дней с даты подписания заказчиком документа о приемке товара (выполнении работы, оказании услуги) по договору или его отдельному этапу. В этих целях ст. 3 Федерального закона от 18 июля 2011 года № 223-ФЗ «О закупках товаров, работ, услуг отдельными видами юридических лиц» планируется дополнить ч. 5.2.
Необходимость нововведения1 аргументируется тем, что 30-дневный срок для оплаты обязательств не распространяется на субъекты крупного бизнеса. А это создает проблемы для крупных промышленных предприятий, поскольку их поставщики материалов чаще всего работают по предоплате, а государственные предприятия могут оплачивать поставленный товар или оказанные услуги в течение шести месяцев.
Напомним, что максимальный срок оплаты исполнения по госконтрактам в рамках Федерального закона от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» (далее – Закон № 44-ФЗ) составляет 30 дней. А со вчерашнего дня изменились Правила оценки заявок, окончательных предложений участников закупок, осуществляемых в рамках Закона № 44-ФЗ.
