Ведомство рассказало1 на своем официальном сайте о том, что выпущены методические рекомендации для прозрачного и недискриминационного доступа производителей и поставщиков продуктов питания в торговые сети.
ФАС России поясняет, что в настоящее время у торговых сетей есть обязанность обнародовать на своем сайте информацию об условиях отбора контрагентов для поставки продуктов – но закон не определяет, какие именно сведения нужно разместить (ч. 1 ст. 9 Федерального закона от 28 декабря 2009 г. № 381-ФЗ «Об основах государственного регулирования торговой деятельности в Российской Федерации»). Поэтому нередко условия доступа товаров «на полку» магазина сформулированы в самом общем виде и вводят поставщиков в заблуждение о реальных потребностях супермаркета, или же информация очень скупая.
Это, добавляют в антимонопольной службе, может приводить к безосновательным отказам в заключении договоров на поставку продуктов питания и дискриминации поставщиков. А производители продовольственных товаров находятся в итоге в существенной рыночной зависимости от торговых сетей.

Разработанные ФАС России Методические рекомендации советуют торговым сетям уточнять виды, порядок, способы, состав и сроки раскрытия информации, которая размещается на их сайтах для поставщиков. Рекомендовано раскрывать следующую информацию:
критерии отбора поставщиков продовольственных товаров; перечень критериев, несоответствие поставщика которому является основанием для отказа в cотрудничестве; перечень торговых объектов торговой сети; описание действующей логистической системы (доставка в торговые объекты и/или в распределительные (логистические) центры); перечень действующих распределительных (логистических) центров; перечень и расценки услуг распределительных (логистических) центров; закрытый перечень требований к товару, таре, упаковке, маркировке, сроку годности, размеру партий, разрешительной и сопроводительной документации; порядок, условия поставки и приемки товара, а также порядок их изменения; порядок введения товара в ассортиментную матрицу; порядок размещения и время для согласования заказов; процедура отказа от поступившего заказа по инициативе поставщика; периоды, сроки и порядок проведения договорных (закупочных) кампаний, в том числе периоды, сроки и порядок работы ассортиментных комитетов (при их наличии); порядок проведения ценовых конкурсов (тендеров) на определенные категории товаров, включающий сроки извещения, сроки и порядок подачи предложений, сроки и порядок рассмотрения предложений и критерии определения победителей (в случае, если предусмотрено проведение таких конкурсов (тендеров)); требования к порядку и форме подачи коммерческих предложений, к их содержанию, в том числе перечень обязательных сведений (информации), адреса для подачи предложений, а также перечень прилагаемых документов; информация о структурном подразделении и/или должностном лице, уполномоченном рассматривать коммерческие/ценовые предложения и принимать соответствующие решения; срок рассмотрения коммерческих предложений и порядок и сроки информирования поставщиков о принятых решениях; условия оплаты товара и проведения взаиморасчетов; порядок документооборота; порядок электронного обмена данными, включая перечень документов, транслируемых через систему электронного документооборота; условия расторжения договоров поставки продовольственных товаров.
Торговые сети также могут рассказать о том, какие у них существуют услуги по продвижению товаров и какова стоимость таких услуг. Еще одна рекомендация – опубликовывать сведения о действующей системе штрафов за нарушения договоров поставок и договоров услуг.
Перечень информации, которую может раскрывать торговая сеть для поставщиков, открытый, и конечный ее состав должны определить сами владельцы супермаркетов.
Указанные сведения рекомендовано размещать на главной странице сайта, а по запросам поставщиков – сообщать адреса сайтов, где можно найти нужную информацию.
