ФНС России на своем официальном сайте опубликовала разъяснения о порядке уплаты авансовых платежей по налогу на прибыль организаций на I квартал 2021 года.
В соответствии с нормами налогового законодательства сумма ежемесячного авансового платежа по налогу на прибыль, подлежащего уплате в первом квартале текущего налогового периода, равна сумме ежемесячного авансового платежа, подлежащего уплате налогоплательщиком в последнем квартале предыдущего налогового периода (п. 2 ст. 286 Налогового кодекса).
Как поясняет налоговая служба, такое же правило применяется и в случае, если ежемесячные авансовые платежи в IV квартале 2020 года были равны нулю. Это возможно в связи с применением налогоплательщиком установленной на 2020 год повышенной предельной величины доходов от реализации (п. 2 ст. 2 Федерального закона от 22 апреля 2020 г. № 121-ФЗ), которая в среднем составляет 25 млн руб. за предыдущие четыре квартала, а по итогам всего года доходы от реализации превысили предельную величину.
