Конституционный Суд Российской Федерации пришел к указанному выводу, рассмотрев обращение гражданки С., по факту незаконности ее увольнения с должности воспитательницы детского сада. В упомянутом детском саду она занимала эту должность в течение 11 лет до 2017 года с 30-летним общим стажем работы воспитательницей. За указанный период она проходила аттестации, получала грамоты, дипломы и благодарности от руководства, а также повышала свою квалификацию. Однако в 2017 году гражданка С. была уволена с должности воспитательницы по причине отсутствия у нее высшего или среднего профессионального образования. Напомним, что его наличие у лиц, осуществляющих педагогическую деятельность, является обязательным с 1 января 2013 года – даты вступления в силу Федерального закона от 29 декабря 2012 г. № 273-ФЗ «Об образовании в Российской Федерации» (далее – закон об образовании).
В своих обращениях заявительница обращала внимание на тот факт, что она продолжала работать и после 1 января 2013 года, причем работодатель не предъявлял к ней никаких претензий, хотя при приеме на работу знал о наличии у нее незаконченного высшего педагогического образования.

Он пояснил, что при введении в действие закона об образовании предполагалось, что требования к образованию педагогов будут предъявляться при решении вопроса о приеме на работу, а не станут использоваться в качестве основания для увольнения с нее лиц, не имеющих нужного образования, но успешно выполняющих свои трудовые обязанности. По мнению Суда, правоприменительная практика, допускающая прекращение трудового договора с воспитателями дошкольных образовательных организаций, принятых на работу до 1 января 2013 года, только по причине несоответствия требованиям ч. 1 ст. 46 закона об образовании, противоречит Конституции РФ. На своем официальном сайте КС РФ указал, что все решения в отношении заявительницы подлежат пересмотру.
Примечательно, что по мнению Верховного Суда Российской Федерации, даже если автопарк юрлица используется им только для собственных нужд, начальник водителей должен иметь специальное образование.
