Суть дела заключалась в том, что за превышение установленных сроков доставки и утрату почтовых отправлений общество С. подверглось административному наказанию за деятельность с нарушением требований и условий, предусмотренных лицензией (ч. 3 ст. 14.1 КоАП РФ).
Представители общества считали, что производство по делу будет прекращено в силу истечения трехмесячного срока. Суды же пришли к заключению, что поскольку пресечение требований лицензионного законодательства со стороны общества привело к нарушению прав граждан-потребителей услуг связи, к этому делу применим годичный срок давности (ч. 1 ст. 4.5 КоАП РФ).

Как отмечает КС РФ в сообщении на своем официальном сайте, при решении вопроса о наказании за осуществление предпринимательской деятельности с нарушением лицензионных требований должен соблюдаться трехмесячный срок давности привлечения к ответственности. Вместе с тем, поясняет Суд, у потребителей есть право требовать возмещения убытков и компенсации морального вреда за нарушение своих прав в течение года. Однако он подчеркивает, что в упомянутом случае годичный срок является специальным и не может применяться в делах о привлечении к административной ответственности за нарушение лицензионного законодательства.
