Соответствующее постановление1 подписал Председатель Правительства РФ Дмитрий Медведев (постановление Правительства РФ от 13 апреля 2017 года № 444 «О внесении изменений в Положение о Министерстве образования и науки Российской Федерации»).
Напомним, в декабре 2016 года был принят ряд поправок в законодательство в целях совершенствования организации отдыха и оздоровления детей, которыми, в частности, были конкретизированы полномочия в этой сфере федеральных и региональных органов власти (Федеральный закон от 28 декабря 2016 г. № 465-ФЗ). Так, было определено, что уполномоченный федеральный орган должен разрабатывать примерные положения и методические рекомендации об организации детского отдыха, осуществлять контрольные функции, определять основные направления государственной политики в данном направлении и т. д. А на региональные органы возложены обязанности по формированию и ведению реестров организаций отдыха детей и их оздоровления. Также они должны определять региональную политику по детскому отдыху и осуществлять контроль за соблюдением соответствующего законодательства – но на уровне субъектов Федерации (ст. 12.1 Федерального закона от 24 июля 1998 г. № 124-ФЗ «Об основных гарантиях прав ребенка в Российской Федерации»).
Для реализации новых норм были утверждены Изменения в Положение о Минобрнауки России, согласно которым министерство, в частности, наделяется новыми полномочиями по:
разработке и реализации основ государственной политики в сфере организации отдыха и оздоровления детей, включая обеспечение безопасности их жизни и здоровья;
координации деятельности федеральных органов исполнительной власти и взаимодействию с органами исполнительной власти субъектов Федерации, органами местного самоуправления и организациями отдыха детей и их оздоровления;
обеспечению федерального государственного контроля за соблюдением требований законодательства в сфере организации отдыха и оздоровления детей;
разработке и принятию примерных положений об организациях отдыха детей и их оздоровления, а также изданию методических рекомендаций по обеспечению организации отдыха и оздоровления детей (п. 1-4 Изменений).
Изменения вступают в силу с 25 апреля текущего года.
