Об этом сообщается на официальном сайте ФПА России со ссылкой на план1 законопроектной деятельности Правительства РФ. Предположительно, кабмин сможет определять требования к порядку деятельности адвокатов иностранных государств, осуществляющих деятельность на территории России, но о каких именно требованиях идет речь – не уточняется.
Подготовить соответствующий законопроект к октябрю текущего года должен будет Минюст России, а в Госдуму документ планируется внести в декабре.
Исполнительный вице-президент ФПА РФ Андрей Сучков считает, что разработка подобных поправок ожидаема. По его оценке, в настоящее время законодательное регулирование в этом вопросе лаконично.
Так, иностранные адвокаты должны быть зарегистрированы в специальном реестре Минюста России, для чего они предоставляют в ведомство ряд документов (п. 6 ст. 2 Федерального закона от 31 мая 2002 г. № 63-ФЗ «Об адвокатской деятельности и адвокатуре в Российской Федерации»; далее – закон об адвокатуре, п. 2, п. 4 Положения о ведении реестра адвокатов иностранных государств, осуществляющих адвокатскую деятельность на территории Российской Федерации). Кроме того, они вправе оказывать на территории России юридическую помощь только по вопросам права своего государства и не могут вести дела, связанные с российской гостайной (п. 5 ст. 2 закона об адвокатуре).
Как отметил Андрей Сучков, вопросы адвокатской деятельности гораздо обширнее, в связи с чем данные нормы не охватывают всего многообразия этой работы. «Поэтому законодательное наделение Правительства РФ полномочиями по установлению требований к порядку деятельности адвокатов иностранных государств, осуществляющих деятельность на территории Российской Федерации, вполне обоснованно», – заключил он.
