В Госдуму внесен законопроект, предусматривающий расширение случаев применения имущественного налогового вычета по НДФЛ. Так, предлагается разрешить применять вычет при покупке легкового автомобиля. Законопроектом1 устанавливается и ряд условий, выполнение которых необходимо для получения вычета:
автомобиль должен быть легковым;произведен на территории России;приобретен для личных и семейных нуждфактические расходы на его приобретение не превышают 1 млн руб.автомобиль ранее не находился на регистрационном учете.
Предлагается установить, что вычет будут предоставляться в размере 10% от суммы фактически произведенных налогоплательщиком расходов на приобретение машины. К таким расходам может быть отнесена не только стоимость самого автомобиля, но установка допоборудования при его покупке, а также затраты на его переоборудование для использования инвалидами.
Согласно законопроекту, воспользоваться правом на вычет налогоплательщик сможет только после госрегистрации автомобиля. При этом вычет может предоставляться и повторно, но не ранее чем по истечении пяти лет после обращения налогоплательщика за получением предыдущего налогового вычета
Для получения вычета физлицу нужно будет представить в налоговый орган договор о приобретении автомобиля, ПТС, свидетельство о госрегистрации, а также документы, подтверждающие произведенные налогоплательщиком расходы (установка допоборудования или переоборудование автомобиля), например, квитанции к приходным ордерам, банковские выписки о перечислении денежных средств со счета покупателя на счет продавца, товарные и кассовые чеки и другие документы.
