При наличии основного долга перед микрофинансовой организацией в размере не более 5 млн руб. юрлицо или ИП все равно смогут получить микрозаем от этой организации (Федеральный закон от 27 декабря 2018 г. № 537-ФЗ «О внесении изменений в Федеральный закон «О развитии малого и среднего предпринимательства в Российской Федерации» и статью 12 Федерального закона «О микрофинансовой деятельности и микрофинансовых организациях»). Такое нововведение начнет действовать с 8 января этого года. Пока изменения не вступили в силу, предельный размер долга составляет 3 млн руб. (п. 8 ч. 1 ст. 12 Федерального закона от 2 июля 2010 г. № 151-ФЗ «О микрофинансовой деятельности и микрофинансовых организациях»).
А с 28 января начнет действовать закон о постепенном ограничении предельной суммы долга по потребительским кредитам. И кроме того, как разъяснил сегодня Банк России на своем официальном сайте, законодатель, принимая в расчет средний размер краткосрочного займа «до зарплаты», вводит с той же даты новый особый вид займа, в сумме до 10 тыс. руб. и на срок до 15 дней. Причем сумма процентов по нему не должна превышать 3 тыс. руб. либо 30% от суммы займа, если на тот же срок выдано менее 10 тыс. руб., а ежедневная выплата не может составлять больше 200 руб. Заем нельзя будет продлить или увеличить его сумму.
