Минпромторг России предлагает снять ряд ограничений с магазинов франчайзинговых программ, ориентированных на поддержку владельцев и операторов небольших продуктовых магазинов формата «у дома». Для этого разработанным министерством законопроектом планируется установить правило, в соответствии с которым размер выручки торговой сети от реализации товаров за предшествующий календарный год должен превышать 2 млрд руб. Как отмечается в пояснительной записке к документу1, нововведения позволят освободить предприятия малого и среднего торгового бизнеса от требований, предъявляемых к торговым сетям.
Также документом предполагается, что совокупность двух и более торговых объектов, принадлежащих на законном основании одному или нескольким хозяйствующим субъектам, входящим в одну группу лиц, или использующихся под единым коммерческим обозначением или иным средством индивидуализации, не будет признаваться торговой сетью, если таким обозначением пользуются субъекты МСП.
Кроме того, в случае принятия законопроекта логистические услуги исключат из совокупного размера вознаграждения, выплачиваемого хозяйствующему субъекту, осуществляющему торговлю в связи с приобретением им у поставщика определенного количества продовольственных товаров. Публичное обсуждение и независимая антикоррупционная экспертиза документа завершатся 4 марта.
