О современных механизмах предотвращения недобросовестных действий со стороны третьих лиц в отношении недвижимости, принадлежащей законным владельцам, рассказали сотрудники Управления Росреестра по Москве. Соответствующий материал появился на официальном сайте Росреестра.
В частности, говорится об анализе документов, проводимом государственными регистраторами в ходе правовой экспертизы в целях защиты имущественных прав граждан. При возникновении сомнений в подлинности представленных документов регистратор может запросить у соответствующих органов власти дополнительную информацию, подтверждающую факт выдачи и достоверность содержащихся в документах сведений. В случае получения сведений о недостоверности документов регистратор откажет в госрегистрации прав, а поступившие материалы передаст в правоохранительные органы для проверки.
Однако, если регистратору поступают нотариально заверенные документы, которые проверены нотариусом на этапе удостоверения сделки, то они принимаются без проведения правовой экспертизы. В данном случае нотариус несет имущественную ответственность за вред, причиненный по его вине имуществу гражданина или юрлица в результате совершения нотариального действия с нарушением закона.
В качестве основных мер защиты недвижимости от мошеннических действий указываются следующие:
направление в Росреестр заявления о невозможности регистрации перехода, прекращения, ограничения права и обременения объекта недвижимости без личного участия собственника имущества (соответствующая запись вносится в Единый государственный реестр недвижимости и служит основанием для возврата без рассмотрения документов, поданных не только третьими лицами по нотариально удостоверенной доверенности, но и нотариусами);использование усиленной квалифицированной электронной подписи при регистрации прав в электронном виде (это приравнивается к личному участию);внесение правообладателем недвижимости в ЕГРН записи о возможности осуществления госрегистрации на основании заявления и прилагаемых к нему документов, подписанных усиленной квалифицированной электронной подписью (подача такого заявления возможна как в отношении всех принадлежащих собственнику объектов недвижимости, так и любого из них).
Также эксперты напоминают о поправке, вступившей в силу с 1 ноября, согласно которой Росреестр будет уведомлять владельцев недвижимости о поступивших в электронном виде документах по почте и электронной почте. Но для корректной работы такого механизма необходимо актуализировать содержащиеся в ЕГРН контактные данные собственников.
