В соответствии с Указанием Банка России от 8 октября 2019 года № 5283-У «О внесении изменений в Положение Банка Росcии от 19 сентября 2014 г. № 431-П «О правилах обязательного страхования гражданской ответственности владельцев транспортных средств» (далее – Указание Банка России) известить страховщика о ДТП станет возможным посредством использования интернет-сайта и Единого портала госуслуг. Внесенные изменения вступят в силу с 10 ноября 2019 года.
В частности, определены правила заполнения извещения о ДТП в электронном виде, новая форма которого утверждена. В отличие от ранее действовавшего порядка, который требовал заполнять извещение водителями независимо от участия в оформлении ДТП сотрудников полиции, с 10 ноября 2019 года такое извещение при участии полицейских водителям заполнять не потребуется.
Электронное извещение может быть составлено и направлено страховщикам без участия сотрудников полиции:
если у участников ДТП нет разногласий по повреждениям транспортных средств, их характеру и перечню видимых повреждений;если автовладельцы – физические лица;если портал госуслуг позволяет составить электронное извещение;если хотя бы у одного из участников ДТП имеется необходимое программное обеспечение для составления электронного извещения.
Такое извещение будет считаться направленным страховщику, если отправившему его страхователю придет соответствующий отчет о направлении.Кроме того, определены случаи признания сведений в заявлении автовладельца о заключении договора об ОСАГО недостоверными. Недостоверными считаются такие сведения, по которым страховщиком получен отказ в их подтверждении. Он может быть основан на информации с портала госуслуг либо полученной вследствие межведомственного электронного взаимодействия органов госвласти. Страховщик должен сообщить владельцу транспортного средства о необходимости корректировки сведений. В случае наличия ошибок в предоставленных владельцем автомашины данных оплату страховой премии через официальный сайт страховщика провести будет невозможно.
Если же заявление подано безошибочно, то сразу после оплаты страховой премии страховой полис направят страхователю по электронной почте и разместят в личном кабинете страхователя. За внесение изменений в полис ОСАГО (в виде электронного документа) страхователь обязан уплатить дополнительную страховую премию. Страховщик должен внести изменения в страховой полис и направить его страхователю в срок не позднее двух рабочих дней с момента поступления оплаты.
Напомним, что использовать электронный страховой полис вместо бумажного автовладельцы могли с момента вступления в силу соответствующих положений Федерального закона от 23 июня 2016 г. № 214-ФЗ «О внесении изменений в Федеральный закон «Об обязательном страховании гражданской ответственности владельцев транспортных средств» – с 1 января 2017 года. Действие бланков страховых полисов старого образца (и их дубликатов) продлится до 1 апреля следующего года.
