ФПА рассказала1 на своем официальном сайте об одном из недавних судебных дел, связанном с вознаграждением адвоката по назначению.
20 апреля 2021 года адвокат АП Ивановской области К. осуществляла защиту обвиняемого Ц. в судебном заседании. Предметом заседания было рассмотрение ходатайства следователя о продлении Ц. срока содержания под стражей. Ранее по данному делу адвокат не принимала участия, а была приглашена в суд по инициативе следователя (по заявке, направленной в палату через систему распределения дел).
Затем адвокат К. обратилась в следственное управление Следственного комитета РФ по Ивановской области с заявлением о выплате вознаграждения в размере 3360 руб. В эту сумму адвокат включила оплату за участие в судебном заседании 20 апреля, а также за ознакомление с материалами дела 19 апреля, которое происходило в приемной председателя Фрунзенского районного суда г. Иваново.
Следователь удовлетворил это заявление частично: было вынесено постановление о возмещении процессуальных издержек адвокату К. за один день участия в защите обвиняемого на сумму 1,5 тыс. руб. По мнению следователя, оснований увеличения размера вознаграждения адвоката не было – ведь 19 апреля какие-либо следственные действия с обвиняемым Ц. с участием защитника К. либо иного адвоката не проводились.
Адвокат обжаловала это решение в суде и добилась защиты своих интересов. Суд указал, что при определении размера вознаграждения адвоката, участвующего в уголовном деле по назначению следователя, подлежит учету время, затраченное адвокатом на осуществление полномочий, предусмотренных ч. 1 и ч. 2 ст. 53 УПК РФ, а также на осуществление других действий адвоката по оказанию квалифицированной юридической помощи при условии представления подтверждающих документов (п. 23 Положения о возмещении процессуальных издержек (утв. постановлением Правительства РФ от 1 декабря 2012 г. № 1240); далее – Положение).
Иными словами, суд признал право на оплату труда адвоката по ознакомлению с материалами дела. По мнению суда, без ознакомления с представленными в суд материалами осуществление защиты было бы невозможно с учетом того, что ранее адвокат участия в деле не принимала.
Напомним, минимальный размер вознаграждения адвоката по назначению составляет 1,5 тыс. руб. в день. Он варьируется в зависимости от статуса подзащитных, уровня судебной инстанции, времени суток, в течение которого привлекался адвокат, и т. д. (п. 22.1 Положения).
