Законопроект1 о внесении изменений в Федеральный закон от 26 октября 2002 года № 127-ФЗ «О несостоятельности (банкротстве)» внесен на рассмотрение Госдумы сегодня.
Предложенные поправки предоставят возможность применить процедуру банкротства во внесудебном порядке малоимущими гражданами и пенсионерами, чей доход не превышает двухкратной величины прожиточного минимума по субъекту РФ. Это право планируется урегулировать в ст. 223.2 Федерального закона от 26 октября 2002 года № 127-ФЗ «О несостоятельности (банкротстве)» (далее – Закон № 127-ФЗ).
Порядок применения внесудебной процедуры банкротства неплатежеспособными гражданами был введен с сентября прошлого года (Федеральный Закон № 289-ФЗ «О внесении изменений в Федеральный закон «О несостоятельности (банкротстве)» и отдельные законодательные акты РФ») (далее – Закон № 289-ФЗ). Напомним, воспользоваться внесудебным порядком могут только те граждане, у которых:
сумма долга составляет от 50–500 тыс. руб.;судебные приставы не нашли имущество или доходы.
Однако, текущая редакция Закона № 127-ФЗ не учитывает граждан с доходом меньшего или равного прожиточному минимуму, поскольку они на регулярной основе получают определенный доход (пенсию, заработную плату).
Соответственно, невозможность применения внесудебного порядка банкротства такими гражданами приводит к удержанию половины их ежемесячного дохода в рамках исполнительного производства. Этот факт не учитывает, что оставшаяся часть средств не позволяет гражданам удовлетворять минимальные потребности, такие как оплата коммунальных платежей, покупка еды.
