Минюст России представил на общественное обсуждение проект порядка прохождения стажировки у нотариуса лицами, желающими сдать квалификационный экзамен на должность нотариуса1. Текст документа и материалов к нему размещен на федеральном портале нормативных правовых актов.
Сегодня действует порядок прохождения стажировки лицами, претендующими на должность нотариуса, утвержденный приказом Минюста России от 29 июня 2015 г. № 151. В соответствии с ч. 4 ст. 19 Основ законодательства РФ о нотариате от 11 февраля 1993 г. № 4462-I стажировка у нотариуса длится один год, за исключением отдельных случаев.
Новая редакция порядка предлагает определить ежегодное число лиц, которые могут пройти стажировку в нотариальных палатах субъектов РФ (далее — нотариальные палаты), по согласованию с территориальными органами Минюста России. Их не может быть менее 5% численности нотариусов в нотариальной палате. При этом нотариальная палата вправе будет принимать стажеров в большем количестве. Сегодня численность стажеров определяется произвольно. Проектом порядка планируется усовершенствовать процедуру сдачи документов и прохождения экзамена претендентом в стажеры.
Документами для прохождения стажировки, как и сегодня, являются копии паспорта, и диплома о высшем юридическом образовании, выданного вузом с государственной аккредитацией. Нововведением является подача заявления и документов по электронной почте при наличии усиленной квалифицированной электронной подписи. В этом случае документ, удостоверяющий личность, можно не представлять.
Если число претендентов превышает определенное количество стажеров, будут проводить экзамен с целью выявления наиболее подготовленных лиц. Срок размещения информации в нотариальной палате, в том числе на ее сайте о допущенных к экзамену лицах, о дате его проведения, о примерных вопросах планируют увеличить с двух до пяти дней с даты принятия решения о проведении такого экзамена. При этом претендентам дадут возможность подготовиться к экзамену. Ранее 20-го дня с момента размещения этой информации его не назначат.
Минимальное число членов экзаменационной комиссии планируется снизить с 6 до 3 человек. Экзамен предлагается проводить в форме теста из 100 вопросов, с обеспечением анонимной проверки результатов с использованием автоматизированной информационной системы ФНП, для доступа в которую выдадут логин и пароль.
Помимо этого, новая редакция также предусматривает обязательную программу стажировки, состоящую из трех этапов:
получение стажером специальных теоретических знаний (121 академический час);приобретение практических навыков организации работы нотариуса – 400 астрономических часов (со стажером подпишут соглашение о неразглашении нотариальной тайны, ставшей ему известной при работе с нотариусом);программу третьего этапа стажировки утверждает нотариальная палата, которая организует прохождение тестирования по теоретическим знаниям.
Контроль за стажировкой будет осуществляться по электронному дневнику стажировки. Руководитель стажировки составит свое заключение, в котором проставит оценки по каждому этапу и сделает вывод о готовности кандидата к сдаче квалификационного экзамена на должность нотариуса.
Нотариальная палата в 15-дневный срок с даты окончания стажировки должна принять одно из решений:
о допуске к сдаче квалификационного экзамена;о признании лица не прошедшим стажировку с выставлением конкретной оценки по отдельному этапу;о продлении стажировки ввиду неполного прохождения программы по уважительным причинам.
Те, кто не прошел стажировку, смогут попробовать свои силы вновь на общих основаниях.
Нововведения, по мнению разработчиков, позволят исключить фактор коррупциогенности и привлечь к нотариальной деятельности высококвалифицированных специалистов.
Независимая антикоррупционная экспертиза проекта документа продлится до 13 ноября.
