С таким законопроектом1 выступил член Совета Федерации Сергей Калашников. Предлагается расширить перечень оснований досрочного прекращения полномочий судьи и включить в него такое основание, как трехкратная отмена решений судьи вышестоящим судом. При этом отмечается, что это условие не будет действовать в отношении решений судов присяжных или судебных решений, принимаемых коллегиально. Сенатор пояснил также, что оно не будет распространяться на случаи изменения решения судьи судом вышестоящей инстанции.
Напомним, что сегодня предусмотрен исчерпывающий перечень оснований для досрочного прекращения полномочий судьи среди которых:
нарушение судьей, его супругой (супругом) и несовершеннолетними детьми запрета открывать и иметь счета (вклады) в зарубежных банках; занятие деятельностью, не совместимой с должностью судьи; вступление в законную силу обвинительного приговора суда в отношении судьи либо судебного решения о применении к нему принудительных мер медицинского характера; вступление в законную силу решения суда об ограничении дееспособности судьи либо о признании его недееспособным; случай, когда судья оказывается состоящим в близком родстве или свойстве с председателем или заместителем председателя того же суда и отказывается от перевода в другой суд; совершение судьей дисциплинарного проступка, за который решением квалификационной коллегии судей на него наложено дисциплинарное взыскание в виде досрочного прекращения полномочий судьи и т. д. (п. 1 ст. 14 Закона РФ от 26 июня 1992 г. № 3132-I «О статусе судей в Российской Федерации»).
В пояснительной записке к законопроекту отмечается, что дополнение существующего перечня оснований для досрочного прекращения полномочий судьи обеспечит снижение неправосудных и несправедливых решений. По мнению разработчика документа, судьи станут учитывать, что трехкратная отмена их решений будет являться основанием для прекращения полномочий. Сергей Калашников надеется, что благодаря поправкам судьи будут стремиться в максимальной степени обеспечивать законность судебного процесса.
По мнению автора законопроекта, принятие вносимых изменений позволит исключить злоупотребления судей своими полномочиями, а также повысить эффективность судебной деятельности и доступность правосудия.
