С 1 марта вступила в силу норма Федерального закона от 31 мая 2002 г. № 63-ФЗ «Об адвокатской деятельности и адвокатуре в Российской Федерации» (далее – Закон № 63-ФЗ) (в ред. Федерального закона от 2 декабря 2019 г. № 400-ФЗ), обязывающая адвокатские палаты (как федеральную, так и региональные) вести сайт в Интернете и размещать на нем определенную информацию. Такое требование нацелено на обеспечение доступа адвокатов к информации о своей деятельности, а также доступа граждан, юрлиц, общественных объединений, органов госвласти и органов местного самоуправления к необходимой информации.
Положения новой нормы конкретизированы в Порядке ведения адвокатской палатой субъекта Российской Федерации сайта в информационно-телекоммуникационной сети «Интернет» и размещения на нем информации (далее – Порядок), утв. решением Совета ФПА РФ 14 февраля 2020 года. Документ значительно расширяет перечень информации, необходимой для размещения на сайтах региональных адвокатских палат, по сравнению с тем объемом сведений, которые предусматривает Закон № 63-ФЗ. Так, последний ограничивается указанием на сведения о:
годовой финансовой отчетности адвокатской палаты;решениях, принятых советом адвокатской палаты;сделках адвокатской палаты, в совершении которых имеется заинтересованность членов совета адвокатской палаты.
Несмотря на то что Порядком право решения вопросов организации работы, структуры, информационного наполнения и оформления интернет-сайта предоставлено самим адвокатским палатам, ряд дополнительных к указанным в Законе № 63-ФЗ обязательных требований все же введен. В частности, в качестве обязательной для размещения на сайте адвокатской палаты упоминается следующая информация: графики приема граждан адвокатами (в случае участия адвокатов в деятельности государственной системы бесплатной юридической помощи); информация для приема уведомлений о назначении защитника – в случае использования специальной формы на интернет-сайте адвокатской палаты; информация по вопросам противодействия легализации (отмыванию) доходов, полученных преступным путем, и финансированию терроризма.
При этом уточняется, что решения органов адвокатской палаты, устанавливающие права и обязанности адвокатов, как правило, размещаются в разделе сайта, предназначенном для публикации документов. Допускается их публикация в полном объеме или в части – на усмотрение адвокатской палаты.
Что касается сведений, размещаемых на сайте адвокатской палаты в целях обеспечения доступа интернет-пользователей к официальной информации об адвокатских палатах и адвокатах, а также защиты прав адвокатов, то к ним отнесены следующие:
официальное наименование адвокатской палаты, юридический и почтовый адреса, время работы, контактные телефоны, адрес электронной почты;Ф. И. О. президента и вице-президентов адвокатской палаты;Ф. И. О. членов совета, квалификационной и ревизионной комиссий адвокатской палаты;Ф. И. О. членов комиссии по защите прав адвоката и/или полномочных представителей адвокатской палаты в области защиты профессиональных прав адвокатов с указанием контактных телефонов;информация об адвокатах, являющихся членами адвокатской палаты (Ф. И. О., регистрационный номер в реестре адвокатов субъекта РФ, включая номер субъекта РФ, сведения о статусе адвоката (действующий, приостановленный, возобновленный, прекращенный) или об изменении адвокатом членства в адвокатской палате одного субъекта РФ на членство в адвокатской палате другого субъекта РФ, информация об избранном адвокатском образовании);наименования, адреса и контактные телефоны действующих на территории региона адвокатских образований и их филиалов с указанием Ф. И. О руководителей;ссылки для перехода на главные страницы официальных сайтов ФПА РФ (https://fparf.ru/) и «Адвокатской газеты» (https://www.advgazeta.ru/).
Дополнительно к перечисленному рекомендуется публиковать на сайтах адвокатских палат информацию: о совете молодых адвокатов, иных советах, комиссиях и рабочих органах адвокатской палаты; об участии адвокатов в качестве защитников (представителей) по назначению в уголовном, административном и гражданском судопроизводстве; об оказании адвокатами бесплатной юридической помощи социально незащищенным категориям граждан; о повышении профессионального уровня адвокатов. Кроме того, целесообразно выкладывать и информацию для претендентов на приобретение статуса адвоката, а также о федеральных и местных событиях в сфере адвокатской деятельности и адвокатуры. При этом новости можно размещать в кратком виде – с обязательным указанием даты и названия события и переходом по ссылке на интернет-ресурс, на котором опубликована основная информация о событии (например, ссылкой на сообщение об участии адвокатов в оказании бесплатной юридической помощи гражданам, имеющееся на сайте регионального уполномоченного по правам человека).
Уточнено, что информация (в том числе новости, документы и иные материалы) может размещаться непосредственно на интернет-сайте адвокатской палаты или с использованием ссылки для перехода на иные открытые источники, включая сайт ФПА РФ. При этом каждой адвокатской палате предписано определить лицо, ответственное за ведение сайта палаты и размещение на нем информации. Контактная информация об этих лицах должна быть представлена в Департамент информационного обеспечения ФПА РФ не позднее 31 марта. Согласно Порядку информация на интернет-сайте адвокатской палаты должна актуализироваться не реже одного раза в месяц.
Отметим, в настоящее время во всех 85 регионах России созданы официальные сайты адвокатских палат. На большинстве из них уже имеется информация, обязательная к размещению. А на некоторых сайтах (например, в Москве, Хабаровском крае) для адвокатов и руководителей адвокатских образований даже создан личный кабинет, который позволяет просматривать заявки по судам и следствию, а также графики дежурств (руководители адвокатских образований могут видеть данные всех своих адвокатов, а адвокаты – только свои данные).
Новый порядок ведения адвокатской палатой субъекта РФ сайта в Интернете вступил в силу с 1 марта. Но для приведения интернет-сайтов адвокатских палат в соответствие с ним предусмотрен переходный период – до 31 мая текущего года. Учитывая возрастающее значение сети «Интернет» для адвокатского сообщества, регламентация правил ведения сайтов адвокатских палат является необходимой и своевременной.
Следует учитывать, что Порядок – не единственный документ, регламентирующий процесс использования сети «Интернет» адвокатскими образованиями. С 2016 года действуют Правила поведения адвокатов в информационно-телекоммуникационной сети «Интернет», утв. решением ФПА РФ от 28 сентября 2016 г. Они устанавливают основные принципы деятельности адвокатов в сети «Интернет»: профессионализм, сдержанность и корректность, достоинство, безопасность, корпоративность. «Принадлежность к адвокатскому сообществу как институту гражданского общества предполагает наличие у членов этого сообщества активной гражданской позиции, выражаемой ими, в том числе, публично как по правовым, так и по иным социально значимым проблемам. Проявление этой позиции должно осуществляться с неукоснительным соблюдением принципов профессионального поведения адвокатов и традиций российской адвокатуры, способствовать укреплению доверия как к конкретным адвокатам, так и к адвокатскому сообществу в целом, росту их авторитета», – подчеркивается в документе.
