Президент РФ подписал закон, вносящий поправки в налоговое законодательство в части корректировки условий зачета и возврата излишне уплаченных сумм страховых взносов на ОПС (Федеральный закон от 1 октября 2020 г. № 312-ФЗ). Новые правила начнут действовать с 1 января 2021 года.
В настоящее время действует норма, которая запрещает уточнять платежи в части суммы страховых взносов на ОПС в случае, если по сообщению территориального органа ПФР сведения об этой сумме учтены на индивидуальном лицевом счете застрахованного лица в соответствии с российским законодательством об индивидуальном (персонифицированном) учете в системе обязательного пенсионного страхования (п. 9 ст. 45 Налогового кодекса). В новой редакции с 2021 года эта норма будет исключена.

Вместо этого будет прописано, что сумма излишне уплаченных страховых взносов на ОПС не подлежит возврату только, если, по информации территориального органа ПФР, указанная сумма в соответствии с российским законодательством об индивидуальном (персонифицированном) учете в системе ОПС учтена в индивидуальной части тарифа страховых взносов на индивидуальном лицевом счете застрахованного лица, которому на момент представления заявления о возврате суммы излишне уплаченных страховых взносов назначена страховая пенсия (Федеральный закон от 28 декабря 2013 г. № 400-ФЗ).
