Изменения направлены на внедрение цифровых технологий при оказании специализированными организациями услуги по специальной оценки условий труда. Проектом Федерального закона «О внесении изменений в Федеральный закон «О специальной оценке условий труда» в части совершенствования оказания государственных услуг и цифровой трансформации»1 предлагается внести поправки в Федеральный закон от 28 декабря 2013 года № 426-ФЗ «О специальной оценке условий труда» (далее – Закон № 426-ФЗ). Соответствующий законопроект размещен на федеральном портале проектов нормативных правовых актов 25 июня.
С целью сокращения сроков для реализации специальной оценки условий труда законопроектом предлагается оформлять в электронном виде отчет о результатах специальной оценки условий труда с использованием усиленной квалифицированной электронной подписи (ч. 2 ст. 15 законопроекта) и сертификат экспертов, которые проводят спецоценку условий труда (ч. 1 ст. 20 законопроекта). Также предусматривается установление электронного взаимодействия между специализированной организацией, осуществляющей спецоценку условий труда, и Минтрудом России в части обязательной передачи информации о сокращении области аккредитации испытательной лаборатории (с указанием исключенных вредных и опасных факторов трудового процесса) и изменения состава экспертов у такой организации (ч. 1.2 ст. 19 законопроекта).
Кроме того, изменениями предлагается установить запрет на рассмотрение Минтрудом России разногласий по проведенной экспертизе качества спецоценки условий труда и ее результатов в случаях, когда по указанной экспертизе уже принято и опубликовано решение суда или по отчету спецоценки, утвержденного более чем за 2 года до начала проведения экспертизы качества спецоценки условий труда. В действующей редакции Закона № 426-ФЗ таких условий не устанавливается.
Также предлагается дополнить сведения о результатах проведения специальной оценки в отношении работодателя, которые вносятся в информационную систему учета в соответствии с п. 1 ч. 2 ст. 18 Закона № 426-ФЗ, результатами оценки профессиональных рисков работодателя. Как сообщается в пояснительной записке к законопроекту, для реализации указанного положения необходимо разработать и утвердить порядок сбора результатов оценки профессиональных рисков, а также доработать функционал информационной системы учета результатов проведения спецоценки условий труда.

В случае принятия закона на основании законопроекта, изменения вступят в силу с 1 марта 2022 года, за исключением положений о дополнении сведений о результатах спецоценки информацией о результатах оценки профессиональных рисках, которые вступят в силу с 1 марта 2023 года. Антикоррупционная экспертиза законопроекта, размещенного на федеральном портале проектов нормативных правовых актов, завершится 9 июля, а общественное обсуждение – 15 июля.
