Президент РФ подписал Федеральный закон от 18 марта 2020 г. № 66-ФЗ, которым уточняется правовое регулирование оценочной деятельности. В частности, в Федеральном законе от 29 июля 1998 г. № 135-ФЗ «Об оценочной деятельности» (далее – Закон № 135-ФЗ) скорректированы требования к образованию оценщиков. Так, в ст. 21.1 Закона № 135-ФЗ сокращен срок для повторной сдачи квалификационного экзамена в области оценочной деятельности. Теперь претендент допускается к сдаче такого экзамена не ранее чем через 30 дней (в предыдущей редакции статьи – не ранее чем через 90 дней). Исключено дополнительное требование, согласно которому для получения квалификационного аттестата требуется годичный стаж работы в должности оценщика или его помощника. При этом общее требование к трехлетнему опыту работы в данной сфере сохраняется.
В ст. 24.4 Закона № 135-ФЗ расширен перечень оснований приостановления права осуществления оценочной деятельности: дисциплинарный комитет саморегулируемой организации оценщиков будет вправе принять такое решение в случае отсутствия у оценщика квалификационного аттестата.
Установлен порядок реорганизации саморегулируемой организации оценщиков. Так, НКО, имеющая статус саморегулируемой организации оценщиков, может быть реорганизована только в форме присоединения одной такой организации к другой саморегулируемой организации оценщиков. При этом члены присоединенной организации в течение шести месяцев с момента внесения соответствующих сведений в ЕГРЮЛ о прекращении деятельности прежней организации обязаны подтвердить соответствие требованиям реорганизованной саморегулируемой организации оценщиков. Ранее ст. 22 Закона № 135-ФЗ не допускала реорганизации в каком-либо виде. Соответственно, законом закреплены как правила внесения изменений в ЕГРЮЛ, так и условия формирования компенсационного фонда саморегулируемой организации оценщиков.
Также юрлицу, заключившему договор с заказчиком на проведение оценки, предоставляется право отказаться от проведения оценки объекта и расторгнуть договор, если заказчик не обеспечил предоставление необходимой информации об объекте оценки либо не обеспечил соответствующие договору условия работы. Дополнения об этом внесены в ст. 15.1 Закона № 135-ФЗ.

Кроме того, уточнен порядок внесения сведений об отчете об оценке имущества должника в Единый федеральный реестр сведений о банкротстве. Соответствующие поправки внесены в Федеральный закон от 26 октября 2002 г. № 127-ФЗ «О несостоятельности (банкротстве)». В указанный реестр должны быть включены следующие сведения об отчете об оценке имущества должника:
дата составления, порядковый номер отчета; основание для проведения оценщиком оценки; сведения об оценщике (Ф. И. О, страховой номер индивидуального лицевого счета оценщика в системе ОПС, ИНН, сведения о членстве в саморегулируемой организации оценщиков); точное описание объекта оценки согласно отчету об оценке имущества; дата определения стоимости имущества должника и определенная оценщиком стоимость данного имущества; информация об экспертном заключении на отчет об оценке имущества (сведения об эксперте или экспертах, результаты экспертизы объекта, а в отношении объекта оценки, принадлежащего юрлицу, реквизиты юрлица и балансовая стоимость объекта); иные сведения, предусмотренные законом.
Все указанные сведения с копией отчета об оценке имущества должника должны быть внесены внешним управляющим в реестр в течение двух рабочих дней с момента поступления к нему копии отчета об оценке.
Поправками также предусмотрены особенности передачи в качестве имущественного взноса Государственной корпорации «Ростех» земельных участков, находящихся в федеральной собственности. Изменения внесены в Федеральный закон от 23 ноября 2007 г. № 270-ФЗ «О государственной корпорации по содействию разработке, производству и экспорту высокотехнологичной промышленной продукции «Ростех».
Корреспондирующими нормами дополнена ст. 39.1 Земельного кодекса и изменен Федеральный закон от 2 июня 2016 г. № 172-ФЗ «О внесении изменений в отдельные законодательные акты Российской Федерации».
Федеральный закон от 18 марта 2020 г. № 66-ФЗ вступил в силу 18 марта, за исключением положений, касающихся функций по осуществлению контроля за соблюдением законодательства об оценочной деятельности и иных нормативных правовых актов. Они применимы по истечении 90 дней после дня вступления закона в силу.
