Уголовный кодекс планируется дополнить новой статьей 172.4, которая установит уголовную ответственность за незаконное осуществление деятельности по возврату просроченной задолженности физлиц. Соответствующий законопроект внесен1 в Госдуму группой депутатов нижней палаты парламента.
Действия коллекторов и иных лиц, направленные на возврат задолженности, если они сопровождаются применением насилия или угрозой его применения, уничтожением или повреждением имущества либо угрозой их применения, или распространением заведомо ложных сведений, порочащих честь и достоинство гражданина, предлагается наказывать одним из следующих видов наказания:
штрафом в размере от 300 тыс. до 500 тыс. руб. или в размере зарплаты или иного дохода осужденного за период до 3 лет; принудительными работами на срок до 5 лет; лишением свободы на срок до 5 лет с лишением права занимать определенные должности или заниматься определенной деятельностью на срок до 3 лет или без такового.

В случае если эти деяния совершены организованной группой, наказание предлагается сделать безальтернативным в виде лишения свободы на срок до 12 лет.
В пояснительной записке к законопроекту в обоснование предлагаемых мер указано, что применение при возврате просроченной задолженности к должникам и третьим лицам незаконных методов, выражающихся в насилии или угрозе его применения, уничтожении или угрозе уничтожения имущества, распространении порочащих сведений следует оценивать как общественно опасные деяния. В этой связи действующие правовые нормы об административной ответственности за незаконное осуществление деятельности по возврату просроченной задолженности (ст. 14.57 КоАП) не представляются в достаточной степени эффективными.
Корреспондирующие поправки также предлагается внести в Уголовно-процессуальный кодекс.
