Минтруд России подготовил проект временного порядка установления степени утраты профессиональной трудоспособности в результате несчастных случаев на производстве и профессиональных заболеваний, и порядка выдачи соответствующей справки. Его действие планируется распространять на правоотношения, возникшие с 1 марта по 1 октября текущего года. По данному проекту1 медико-социальную экспертизу (первичную и повторную) на установление степени утраты профессиональной трудоспособности, как и утвержденную процедуру признания лица инвалидом, планируется проводить заочно в целях предотвращения распространения новой коронавирусной инфекции.
Установленную ранее степень утраты профессиональной трудоспособности (процентов утраты профессиональной трудоспособности), срок переосвидетельствования по которой наступит в период действия временного порядка, предлагается продлевать в беззаявительном порядке, с включением в нее всех ранее рекомендованных реабилитационных мероприятий на шесть месяцев. Данная степень будет установлена с даты, до которой она ранее была установлена при предыдущем освидетельствовании.

Согласно проекту решение о продлении степени утраты профессиональной трудоспособности будет принято федеральным учреждением МСЭ не позднее, чем за 3 рабочих дня до истечения ранее установленного срока степени утраты профессиональной трудоспособности. Справку, подтверждающую факт установления степени утраты профессиональной трудоспособности в процентах, программу реабилитации пострадавшего в результате несчастного случая на производстве и профессионального заболевания, предлагается направлять почтой с соблюдением требований законодательства о персональных данных. В случае невозможности направления документов почтой они останутся на хранении в учреждениях МСЭ, а о результатах МСЭ гражданину сообщат по телефону или электронной почтой. Все сведения о продлении действия степени утраты профессиональной трудоспособности будут направлены в ФСС России, а также включены в федеральный реестр инвалидов.
Общественное обсуждение проекта постановления Правительства РФ, размещенного на федеральном портале проектов нормативных правовых актов, закончится 21 апреля.
