Об этом заявил министр экономического развития РФ Максим Решетников, сообщается на официальном сайте ведомства. Речь идет о проекте-спутнике нового закона о контрольно-надзорной деятельности (Федеральный закон от 31 июля 2020 г. № 248-ФЗ «О государственном контроле (надзоре) и муниципальном контроле в Российской Федерации»).
В планах ведомства формализовать все чек-листы и ограничить тем самым возможность усмотрения со стороны инспекторов. В чек-листах будут детально прописаны предмет проверки, конкретные требования к проверяемым, степень их реализации и т. д.
Следующий шаг — это перевод всей документации о проверках в электронную форму. К примеру, предписания будут поступать предпринимателям именно в электронном виде — а не по почте, как нередко происходит сегодня.
«И в конечном итоге все контакты со стороны контролирующих органов и бизнеса будут фиксироваться в электронном виде. Мы всю историю сможем проследить и потом можем понять, если, не дай бог, произошел какой-то инцидент, почему он произошел. Например, была недостаточно тщательно проведена проверка или проверка не проводилась (объект, допустим, не был в зоне риска, в группе риска, а надо было его в группу риска вносить и так далее). Это нам даст еще и пищу для дальнейшего внедрения риск-ориентированного подхода», — отметил министр.
Еще одна важная поправка касается порядка проведения внеплановых и выездных проверок. Предполагается, что они будут проводиться только с разрешения прокурора. «Уже нельзя будет контрольным органам, инспекторам прийти, например, в ресторан, пробить чек, сделать контрольную закупку, а потом это оформить как результат проверки – без предварительного согласования с прокуратурой», — добавил Максим Решетников.
Напомним, что новый закон о контрольно-надзорной деятельности вступит в силу в полном объеме с 1 июля. К этому же сроку должны быть приведены в соответствие с ним все федеральные акты. У регионов и муниципалитетов есть время на эту работу до 1 января 2022 года
