Таким образом постройка является самовольной и подлежит сносу.В частности, в иске говорится, что ответчик — ООО «Столичная судоходная компания» — не получил разрешение на масштабную реконструкцию здания, в результате которой его площадь увеличилась на 1,874 тысячу квадратных метров, составив более 5 тысяч квадратных метров.
В свою очередь представитель ответчика Рубен Маркарьян заявил, что компания «ССК» купила здание порта в 2006г. по договору купли-продажи с ОАО «Пассажирский порт». «Даже если пристроенные в 1990-х и 2000-х годах помещения можно назвать самовольными, например, стеклянный павильон вокруг основного здания, то это не дает права властям Москвы сносить весь объект, построенный 32 года назад и имеющий стратегическое значение в качестве объекта гражданской обороны», — отметил адвокат Маркарьян.Изменения в ст. 222 Гражданского кодекса РФ, внесенные в июле 2015г., дали право сносить построенные объекты, если они расположены на земельном участке незаконно и находятся в зоне с особыми условиями использования: в полосе отвода инженерных сетей, на территориях общего пользования.
В декабре 2015г. столичное правительство издало приказ № 829-ПП «О мерах по обеспечению сноса самовольных построек на отдельных территориях города Москвы».
